Terms & Conditions:

The following terms and conditions govern the sale of products by TireStock.Inc. By submitting your order to us, you are indicating acceptance to be bound by these terms and conditions. These terms and conditions may be changed without prior notice at the sole discretion of TireStock.Inc.

The products and pricing listed on our website are not to be considered offers to sell, but rather advertisements to receive offers of purchase. All orders are subject to review and acceptance by TireStock.Inc. All prices are subject to change so your order may not be accepted or you may be advised of issues of pricing or availability in regards to your order.

Order Acceptance Policy:

Receipt of order confirmation sent to you does not signify our acceptance of the order nor does it constitute confirmation of an offer to sell. TireStock.Inc. reserves the right to accept or decline your order for any reason at anytime after receiving your order. Only based on shipping confirmation will our acceptance of your order be confirmed. All orders must be pre-approved with an acceptable method of payment before shipment occurs. We may need additional information for verification purposes before we accept any order.

All prices shown on TireStock.ca are in Canadian Dollars and do not include the applicable taxes unless otherwise noted. Price charged for orders will be the price at the time of the order.

Typographical Errors:

TireStock.Inc. reserves the right in the event of any item listed at an incorrect price or with incorrect information due to a typographical error or an error on information received from our suppliers to decline and/or cancel any orders for the incorrectly listed item. We may cancel at our discretion orders which may or may not have been confirmed including orders which may have been paid for or charged to your credit card. In the event a charge has been made to your credit card, TireStock.Inc. will immediately issue a credit to your card to offset the purchase.

Recycling Fees:

As of September 1st, 2009, the Ontario Tire Stewardship (OTS) program plan became effective under the Waste Diversion Act, 2002 (WDA), which was introduced by the Ontario Ministry of Environment. To ensure the rubber products are recycled properly, the OTS program plan requires fees to be paid for the rubber tires supplied to Ontario. This is being regulated by Ontario Tire Stewardship (OTS).

Under this regulation, TireStock.Inc. will be charging additional recycling fees on purchases based on the fee structure provided by OTS. Such fees only apply to the products purchased within the province of Ontario. Since these fees are additions to the costs of products, they will be reflected on your invoice at the point of checkout.

Payment Terms:

Payment may be made by Company Check, Cash or credit card. Orders will only be processed based on confirmation of payment.

Inventory Security Policy:

TireStock has the right to own the merchandise which has not been paid, and/or the invalid payment, such as bounced check. TireStock has the right to take the merchandise back from customers if we could not receive the valid payment.

Limitation of Liability:

The maximum liability to you on products purchased from TireStock.Inc. shall be limited to the purchase price of the products you paid. TireStock.Inc. will not be liable for any property damage, personal injury, loss of use, interruption of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages. This applies in all cases however caused, whether for breach of warranty, contract, tort (including negligence), strict liability or other reasons. Some of these limitations may not apply in some jurisdictions and those damages limitations not allowed under by exclusion or restriction under law may not apply to you.

Interpretation:

These terms and conditions shall be interpreted under and governed by the federal laws of Canada, without giving effect to conflict of laws rules. The headings used in these Terms and Conditions are for reference purposes only and are not intended to be part of or affecting the meaning of these Terms and Conditions.

Severability:

If any provision of these Terms and Conditions is held to be illegal, invalid or unenforceable, in whole or in part, the legality, validity and enforceability of the remainder shall not be affected nor impaired. The Terms and Conditions stated herein are declared to be Severable.

Assignment:

This agreement with TireStock.Inc. cannot be assigned without TireStock.Inc.’ written authorization. TireStock.Inc. is the intended beneficiary of this agreement. If there is any inconsistency between this agreement and other information or agreements included or relating to products purchased from TireStock.Inc., this agreement will take precedence.
